Big difference between manslaughter & murder, that's why he Can Not be up for the Death Sentence, murder cases not manslaughter .And even then state to state have strict guide-lines if Death Sentence is even an option.

That question is really clueless. Manslaughter by definition precludes the death penalty. You can only get the death penelty for 1st degree murder. You can't get the death penalty for 2nd degree murder, let alone manslaughter (which is a lesser crime).
